Property Law: FSD vs FSSCD for Durational + Conditional Language?
Can someone help me distinguish a situation between Fee simple determinable vs fee simple subject to condition subsequent? I know the former is durational language (as long as) while the later is conditional language (but if, on the condition that). But are there situations with both durational and conditional language?
1) Grantor gives estate to A as long as it is used for non profit = fee simple determinable b/c durational language.
2) Grantor gives estate to A on the condition it is not ised for profit = fee simple subject to condition subsequent b/c conditional language.
3) Grantor gives estate to A as long as it is not used for profit = ??? This seems to have both durational and conditional language? Is this a FSD or FSSCS?
