Am I being scammed by this seller?
I placed an order on Etsy for some loose gemstones. I believe the seller is located in India. It took a while for my order to arrive, presumably because of international shipping and going through customs. When it finally got here, it was the completely wrong order. It contained gemstones, but none of them were what I ordered. I contacted the seller who told me that someone on their team mixed up the orders, apparently because my name is Stephanie and I'm from the USA, and they had another order from a Stephanie in the USA. Weird, but okay, mistakes happen.
I asked them if that meant the other person got my order, and they said that no, they fortunately still have my order and can send it out to me. They asked if I wanted to keep or return the incorrect order and I said I'd be happy to return it if they provided a shipping label. Instead, they asked if I would send this order to the correct person since she is also in the US, and for my trouble, they would include 3 extra stones in my order "worth $15-$20 each." Mind you, there is an obvious language barrier, as this seller speaks limited English. I understand not wanting to have to send the items back to India and then back to the US again, that would take forever, but things seemed off. I thought it was weird that they still had my order. I mean, okay that's good news because I still want the stones I picked out, but why wouldn't they have shipped it yet? If they realized a mistake was made before they shipped it, then why didn't they contact me first?
Also, it makes me uncomfortable that they gave me the other person's address, that seems like a privacy concern. I said I would send the package to the other Stephanie, but I am waiting to see if they send me my package first. They said they would send it out today but I haven't heard anything. I sent a message asking if it was sent and for a tracking number, but they haven't responded. I'm sure the time difference is partially to blame for this, but I am concerned I am being scammed.
Since my order shows as delivered, it makes it seem like I received my order when I did not. I am worried that Etsy buyer protection might not cover this situation. Will Etsy still be able to help me, or will I be going against some kind of policy to forward this package to the right person but mine doesn't arrive? Would I forfeit my right to a refund? Furthermore, I want my order way more than I want a refund. Am I right to hang onto this order while I wait for mine to arrive?
